    1. Competition and Organizer

    The organizer of the competition is Model AG, Industriestrasse 30, 8570 Weinfelden (hereinafter referred to as the organizer)

    Participation is governed exclusively by the following terms and conditions of participation.

     

    2. Participation

    a) Anyone over the age of 18 residing in Switzerland is eligible to participate. However, employees of the organizer and their direct relatives are excluded from participation.

    b) Participation in the competition is only possible from 15.04.2024 to 30.06.2024.

    c) Participation is of course completely free of charge and does not imply the purchase of any good or service.

    d) No registration is required to participate in the competition. The evaluation in the frame of the bag-in-box bet as well as the complete completion and submission of the contact details in the online form are sufficient. Participation by any other means is not envisaged. Incorrect information or incomplete entries cannot be considered. The organizer cannot be held responsible for late or incomplete receipts.

    e) By participating in the competition, the consenting party agrees to these terms and conditions of participation.

     

    3. Implementation and processing

    a) The following prizes will be raffled among all valid entries: 1x travel ink worth CHF 300.-, 3x a soft-shell jacket worth CHF 159.- CHF and 10x limited juice box including bag. As a further prize, all participants who have not won one of the other prizes will receive a 20% voucher for the next purchase in the Model Shop.

    b) The promotion starts on 15.04.2024 and ends on 30.06.2024.

    c) The winners will be drawn in the week following the end of the competition and notified by e-mail or telephone; the winners must confirm receipt of the notification of the prize and the claim of the prize within two weeks of notification of the prize via the contact channels specified within this notification. If this confirmation is not received, the prize will be awarded to another participant in the competition.

    d) The entitlement to the prize also lapses if the transfer of the prize cannot take place within four weeks after the first notification of the prize for reasons that are the responsibility of the winner. The data will only be transmitted within Switzerland. If, after the winner's draw, it turns out that the winner does not have the necessary postal address within Switzerland as stated in the terms and conditions of participation, the prize will be awarded to another participant in the competition.

    e) The right to the prize cannot be assigned and is non-transferable; in addition, the prize is neither withdrawable, nor can it be supplemented or changed. If, for any reason, the prize cannot be provided, the Promoter reserves the right to award an equivalent substitute prize.

    f) The competition can be terminated due to external circumstances without the participant being able to deduce from this.

     

    4. Exclusion from participation

    a)  In the event of a breach of these terms and conditions, the organiser reserves the right to exclude participants from the competition.

    b) Furthermore, the organizer reserves the right to exclude participants who make use of unauthorized aids or otherwise gain advantages through manipulation, such as collective or multiple participations. This is the case, for example, if automatic scripts, hacker tools, Trojans or viruses are used, or if a participant gains an advantage through other unauthorized means. Furthermore, untrue personal information, as well as the use of "fake profiles" can lead to exclusion. In such cases, winnings may also be revoked and/or reclaimed retrospectively.

     

    5. Facebook

    a) The competition is not affiliated with Facebook and is in no way sponsored, endorsed or organized by Facebook.

    b) Participants do not have any claims against Facebook arising from their participation in the competition or from winning the competition.

    c) Enquiries and comments by the participants are to be addressed exclusively to the organiser and not to Facebook.

     

    6. Instagram

    a) The Competition is not affiliated with Instagram and is in no way sponsored, endorsed or organized by Instagram; the participant does not incur any claims against Instagram. In this respect, the provisions of point 6 shall apply mutatis mutandis.

    b) Entrants may not participate in the competition with multiple accounts. In particular, the creation of several accounts for the supposed purpose of increasing the chances of winning is prohibited.

     

    7. LinkedIn

    a) The Competition is not affiliated with LinkedIn and is in no way sponsored, endorsed or organized by LinkedIn; the participant does not incur any claims against LinkedIn. In this respect, the provisions of point 6 shall apply mutatis mutandis.

    b) Entrants may not participate in the competition with multiple accounts. In particular, the creation of several accounts for the supposed purpose of increasing the chances of winning is prohibited.

     

    8. Data protection

    The organiser collects, processes and uses the personal data provided by the participants when participating in the competition (name, address, e-mail address, telephone number) for the purpose of carrying out the competition, in particular for the purpose of notifying the winners.

    The Promoter reserves the right to use the winner's data for promotional purposes. Participants consent to the use of their data for this purpose.

    Accordingly, data processing is based on Art. 6 (1) (b) GDPR. For details on the type and scope of data processing, please refer to our detailed privacy policy.

    The responsible body or controller within the meaning of the BDSG or the GDPR is the organizer of the competition:

    Of course, every participant has the right at any time to request information about the data stored by the organizer regarding his or her person in accordance with Art. 15 GDPR. The same applies to the deletion of the corresponding data by the organizer in accordance with Art. 17 GDPR, as well as the correction in accordance with Art. 16 GDPR and blocking of the data in accordance with § 18 GDPR.

    You can also object to data processing that the organiser bases on Art. 6 (1) (e) or (f) GDPR under the conditions of Art. 21 GDPR. Of course, you also have the right to complain about the processing of your data to the competent supervisory authority.

    9. Liability of the Organiser

    a) The Organiser shall not be liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical systems and the service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damage has been caused intentionally or through gross negligence on the part of the Organiser (its organs, employees or vicarious agents). The above limitation of liability does not apply in the event of injury to life, limb or health as well as in the event of fraudulently concealed defects. The competition is subject exclusively to the laws of Switzerland. Legal recourse is excluded.

    b) In accordance with Directive 2013/11/EU, the EU Commission shall set up an internet platform for the online settlement of disputes between traders and consumers ("ODR platform"). This can be reached at the following link: http://ec.europa.eu/consumers/odr. However, Model AG would like to point out that it is generally not prepared to participate in arbitration proceedings.

     

    10. Final Provisions

    a) Legal recourse is excluded.

    b) Swiss law applies.

    c) Should any of these provisions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected. Instead of the invalid provision, the legally permissible provision that comes as close as possible to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these Terms and Conditions of Participation.
